These Terms set forth the Terms and Conditions under which you may use our website and services as offered by us. This website offers visitors to purchase clothing items. Access to and use of this website and the products and services available to purchase through this site are subject to the following Terms and Conditions. By using this website you are agreeing to be bound by our Terms and Conditions and our Privacy Policy.

 

The Terms and Conditions may be changed or updated by THE ARCHIVE CLOSET LONDON LTD from time to time (e.g. to reflect changes in technology, our business model, our system capacity or changes to relevant legislation and regulations) and without prior notice. We will indicate at the top of the Terms and Conditions the date on which they were last updated and any use of the site following such a change assumes acceptance of the new Terms and Conditions.

 

Please read the following Terms & Conditions carefully before placing an order on our website, as these will apply when you make a purchase from the website. Completing an order on our website and acceptance of our Terms and Conditions mean that you have concluded an agreement with THE ARCHIVE CLOSET LONDON LTD for the delivery of your purchase (hereinafter referred to as the "Agreement"). If you do not agree to these Terms & Conditions, you will not be able to buy goods from the website.

 

Any reference to “you” or “your” means you in your capacity as a user of the Website and any reference to “we”, “us” or “our” means THE ARCHIVE CLOSET LONDON LTD.

 

3. ORDERING

 

Contracts can only be concluded on the website. We do not process orders made in emails, letters or faxes.

 

The website is open 24 hours a day, but may be closed due to maintenance services. To the extent possible, we try to perform such maintenance services during the night.

 

An order placed on a public holiday or during the weekend will be processed on the following business day. You must meet the legal age requirements to purchase goods on the website and possess a valid credit card or payment method that is accepted by us (see Payment Options below).

 

We can only process your order if the delivery address is a residential address or a business address. We do not deliver to PO boxes. Among other things, we reserve the right to cancel the contract of purchase in one of the following situations, without being liable for compensation or other costs:

  • If you do not understand parts of the Terms and Conditions, we recommend that you contact Customer Service before you start shopping on the website.

  • Your payment details are incorrect or cannot be verified.

  • Your order is placed with the purpose of committing fraud etc. or placed in connection with a criminal offense or other unlawful activities.

  • There is an inadvertent error on the website, such as a payment error or the like.

 

The delivery times given are estimated and from time to time may be affected by events outside our control, for example inclement weather or postal strikes, for which we will not be responsible.

 

4. AT WHAT POINT IN THE ORDERING PROCESS ARE YOU BOUND BY YOUR ORDER?

 

When buying an item, you agree that: (i) you are responsible for reading the full item description before making a commitment to buy it: (ii) By placing an order online you make an offer to purchase in accordance with these Terms and Conditions. We will acknowledge receipt of your order both online and via an email order confirmation but this does not constitute our acceptance of your offer to purchase. Your offer has been accepted only when we have confirmed that the order has been dispatched and you enter into a legally binding contract to purchase an item from THE ARCHIVE CLOSET LONDON LTD.

 

The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

 

Before submitting the order you have the option of changing the information that you have provided, including delivery and billing information or payment information. Furthermore, you have the option of making changes to your order or to remove goods from your shopping basket. When you click “Complete payment” and the receipt appears on your screen, you are bound by the contract of purchase. Please read more under "Right of Withdrawal or Cancellation". Please contact our Customer Service if you made a mistake while placing your order - they are ready to help you. You will receive an email confirming your order. After the conclusion of the Contract, the provisions on withdrawal apply. Please see the “Right of Withdrawal Or Cancellation” section below.

 

5. RIGHT OF WITHDRAWAL OR CANCELLATION

 

Consumers in the European Union, the European Economic Area, and the UK have the right to cancel or withdraw from this contract within fourteen days without giving reasons. The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you have taken possession of the last goods.

 

You may exercise your right of withdrawal until we have confirmed that the order has been dispatched via email confirmation. This open-ended right will end when the dispatch email confirmation is sent and you enter into a legally binding contract to purchase an item from THE ARCHIVE CLOSET LONDON LTD, after which you can move to the right to cancel if appropriate.

 

In case of a contract relating to multiple goods ordered in one order and delivered separately (i.e. separate deliveries), the cancellation period shall expire 14 days after the date on which 1) you or a third party other than the carrier and indicated by you acquires physical possession of the last good or 2) the last good was delivered to a carrier pick-up point selected by you at the time of ordering.

 

In case of a contract relating to delivery of an order consisting of multiple lots or pieces, the cancellation period shall expire 14 days after the date on which 1) you or a third party other than the carrier and indicated by you acquires physical possession of the last lot or piece or 2) the last lot or piece was delivered to a carrier pick-up point selected by you at the time of ordering.

 

To exercise your right of withdrawal or cancellation, you must inform us THE ARCHIVE CLOSET LONDON LTD of your decision to withdraw or cancel from this contract by means of a clear declaration (e.g. a letter sent by post  or e-mail). You can use the attached model withdrawal/cancellation form, which is not mandatory.

 

6. EFFECTS OF WITHDRAWAL OR CANCELLATION

 

If you cancel or withdraw from this Agreement, we shall reimburse you immediately and no later than fourteen days from the date on which we received notice of your withdrawal/cancellation from this Agreement for all payments we have received from you. We will use the same means of payment used by you in the original transaction for such refund, unless expressly agreed otherwise with you and in no event will you be charged for such refund. We may refuse a refund until we have received the goods back.

 

You must return the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this Agreement. This period shall be deemed to have been observed if you dispatch the goods before expiry of the period of fourteen days.

 

The costs for the return shipment as well as any related costs for importing the goods back to the United Kingdom shall be borne by you.

 

You shall only be liable for any loss in value of the goods if such loss in value is due to handling of the goods which is not necessary to inspect their condition, properties and functionality.

 

All goods contained in your order must be returned in their original condition (together with all packaging and labeling), and show no signs of use or damage. We reserve the right to refuse a refund if the goods do not meet this standard.

 

7. EXCLUSION/EXTINCTION OF THE RIGHT OF CANCELLATION:

 

This right does not apply to perishable items, customised goods and items that are sealed for personal hygiene reasons where they have been unsealed.

9. PRODUCTS

 

Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. your product may vary slightly from those images. 

 

10. LANGUAGE OF THE CONTRACT

 

The language of the contract is English.


 

11.  SHIPPING COSTS

 

The shipping costs for a standard shipment of shipments with destination within the United Kingdom and European Union are free of charge. The costs for shipping to destinations outside the UK and EU are shown in the shopping cart before you send the order.

 

We do not take over any costs, which result from the introduction into a non-UK or non-EU country directly or indirectly (import sales tax, customs, etc.).

 

12. PRICES

Our prices are in Pound Sterling - GBP (£).

 

The price of the product will be the price indicated on the order pages when you place your order. VAT and any additional charges will be displayed  when you place your order. We use our best efforts to ensure that the price of the product advised to you is correct. 

 

12.1.WE WILL PASS ON CHANGES IN THE RATE OF VAT

 

If the rate of vat changes between your order date and the date we supply the product, we will adjust the rate of vat that you pay, unless you have already paid for the product in full before.

As soon as our PayPal account has been informed about your authorization, the order will be shipped - depending on the delivery time indicated on the item. Your PayPal account will be debited with the actual invoice amount after deduction of any discounts, gift vouchers, etc. immediately after authorization.

 

Payment by credit card

You pay directly in the ordering process by entering your credit card details. When shipping goods, your credit card will be charged with the actual invoice amount after deduction of any discounts, gift vouchers, etc.. In the case of goods that are specially made to customer specifications or are clearly tailored to personal needs, your credit card will immediately be charged with the actual invoice amount after deduction of any discounts, gift vouchers, etc..

Payment by Apple Pay
You can use Apple Pay to pay online in Safari when you see Apple Pay as a payment option. Apple Pay or “Direct Payments Service” allows you to use funds in your Payment Account to make payments directly to our website. In order to use the Apple Pay you agree and comply with Apple Pay Terms and Conditions to conduct transactions through our website. These Terms and Conditions are not regulated or associated with THE ARCHIVE CLOSET LONDON LTD.

Payments by Klarna 
You pay directly via your Klarna account. In order to use Klarna you agree and comply with Klarna Terms and Conditions to conduct transactions through our website. These Terms and Conditions are not regulated or associated with THE ARCHIVE CLOSET LONDON LTD. As soon as our Klarna account has been informed about your authorization, the order will be shipped - depending on the delivery time indicated on the item.  

 

 

13.1.CVV (CREDIT CARD VERIFICATION NUMBER)

 

If you pay by credit card, you will be asked to enter the card's security code. You can find the three-digit security code on the back of your credit card, usually on the right side of the credit card's back. The security code is necessary for the payment to be processed and for maintaining a high level of security. There may also be other similar safeguards.

14. DEFECTIVE GOODS AND INCORRECT ITEMS

 

If your goods are non-conforming or we have delivered incorrect goods, please contact our Customer Service. If you notice the non-conformity or incorrect goods at the time of delivery, you should refuse to receive the goods. In case of non-conforming goods or incorrect goods, you can return the goods and receive a refund of the purchase price and all delivery costs when our Customer Service has processed the returned goods.

 

When contacting Customer Service you will be asked to provide the order number, possibly the goods/item number, and to describe what is wrong with the goods etc. You are not responsible for costs associated with the return of non-conforming goods or incorrect goods. We will refund the purchase price and of course the delivery costs once we have received the goods.

 

THE ARCHIVE CLOSET LONDON LTD reserves the right to reject complaints on products, which have not been handled correctly and according to instructions. Especially when dealing with vintage materials. Our /riːl/cycled premium vintage quality garments might have some minor signs of pre-loved wear. Due to the nature of vintage materials, there might be slight discolorations, marks or thread pulls, which are naturally associated with vintage.

15. RETENTION OF TITLE

 

The goods remain our property until full payment has been received.

Brand names, product names, logos and titles that appear on the website are trademarks or trade names and are property of THE ARCHIVE CLOSET LONDON LTD or our suppliers. Any reproduction of such trademarks or trade names constitutes an infringement of the owner’s rights and is strictly prohibited, unless it is for your own private use.

 

17. WHICH LAWS APPLY TO THIS CONTRACT AND WHERE YOU MAY BRING LEGAL PROCEEDINGS

 

These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.

 

18. FORCE MAJEURE

 

We are not responsible for delays or failure to meet our obligations in relation to the Terms & Conditions, if the delay or the non-compliance is due to events beyond our control.

 

19. LIMITATION OF LIABILITY

 

To the maximum extent permitted by applicable law, in no event shall THE ARCHIVE CLOSET LONDON LTD, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the website.
